Our Rental Contract

FINAL RENTAL AGREEMENT & TERMS AND CONDITIONS

STATE OF ALABAMA

This Rental Agreement (“Agreement”) is entered into between Ready Set Fun Entertainment LLC (“Company,” “we,” “us”) and the customer identified on the order (“Customer,” “you”).

By placing a reservation, submitting payment, or accepting delivery or pickup of rental items, the Customer agrees to all terms and conditions below.

1. RENTAL ITEMS

The Customer agrees to rent the equipment listed in their order confirmation (“Rental Items”). All Rental Items remain the sole property of Ready Set Fun Entertainment LLC at all times.

2. RENTAL PERIOD

The rental period begins at the scheduled pickup or delivery time and ends at the scheduled return or pickup time stated in the order. Late returns may result in additional charges.

3. PAYMENT & FEES

• Full payment is required for the reservation before the delivery date unless otherwise stated or agreed upon with a supervisor of Ready Set Fun Entertainment LLC.

• Prices do not include taxes or additional fees unless specified.

• Additional charges may apply for late returns, damage, missing items, or excessive cleaning.

4. SECURITY DEPOSIT

A refundable security deposit is required and is based upon rental item value per item. Deposits will be returned after inspection and confirmation that all Rental Items are returned in acceptable condition.

5. CUSTOMER RESPONSIBILITIES

The Customer agrees to:

• Use Rental Items only for their intended purpose

• Follow all safety, setup, and operating instructions

• Supervise equipment at all times

• Keep equipment away from water, fire, extreme heat, or unsafe conditions

• Prevent misuse, abuse, or unauthorized alterations

• Not sub-rent, loan, or transfer equipment

6. DAMAGE, LOSS, OR THEFT

The Customer is fully responsible for any loss, theft, damage, or excessive wear during the rental period.

The Customer acknowledges that all Rental Items are under the Customer’s care, custody, and control from the time of delivery or pickup until returned and accepted by Ready Set Fun Entertainment LLC.

If damage or loss occurs, the Customer agrees to pay repair costs or full replacement cost if repair is not possible. Normal wear and tear is excluded.

7. CLEANING

Rental Items must be returned clean and in the same condition as received. An additional cleaning fee of $35.00-$50.00 may apply.

8. CANCELLATIONS & REFUNDS

• Cancellations must comply with booking policy

• Payments may be non-refundable if canceled late

• No refunds for early returns, unused equipment, or weather conditions unless stated. Please see the weather section on this agreement.

9. DELIVERY & PICKUP

If delivery is selected:

• Safe and accessible delivery conditions must be provided

• Someone must be present during delivery and pickup windows

• Failed delivery or pickup may result in additional fees

  Bounce Houses are not available for pick up under any circumstances.

10. ASSUMPTION OF RISK & LIABILITY WAIVER

The Customer acknowledges that use of rental equipment involves inherent risks, including injury, property damage, or death.

The Customer voluntarily assumes all risks, known and unknown.

To the fullest extent permitted under Alabama law, the Customer releases, waives, and holds harmless Ready Set Fun Entertainment LLC, including its owners, members, employees, and agents, from any claims arising from use or possession of Rental Items.

This release includes claims arising from the ordinary negligence of Ready Set Fun Entertainment LLC, but does not apply to willful or wanton misconduct as defined under Alabama law.

11. INDEMNIFICATION

The Customer agrees to indemnify and defend Ready Set Fun Entertainment LLC from any claims, damages, losses, or legal fees arising from:

• Use or misuse of equipment

• Violation of this Agreement

• Injury to persons or property during rental period

12. SAFETY

• Children must be supervised at all times

• Equipment must not be used if damaged

• Use must stop immediately if safety issues arise

13. WEATHER

Outdoor equipment is used at the Customer’s risk. Equipment must not be used in unsafe weather. No refunds are available due to weather, however a credit can be applied to your account if rescheduling is not an option.

14. TERMINATION

Ready Set Fun Entertainment LLC may terminate this Agreement and reclaim equipment without refund for unsafe or improper use.

15. GOVERNING LAW & VENUE

This Agreement is governed by the laws of the State of Alabama. Venue shall lie exclusively in the Alabama county where Ready Set Fun Entertainment LLC is located.

16. SEVERABILITY

If any provision is deemed unenforceable, the remaining provisions remain in effect.

17. ENTIRE AGREEMENT

This Agreement represents the entire understanding between the parties.

21. PHOTO ID ACKNOWLEDGEMENT

Valid government-issued photo ID may be required. Failure to provide ID may result in refusal of equipment release without refund.

22. DAMAGE & CHARGE AUTHORIZATION

The Customer authorizes charges for damage, loss, missing items, cleaning, late fees, or replacement costs.

23. CREDIT CARD HOLD AUTHORIZATION

The Customer authorizes a temporary credit/debit card hold. Charges may be processed within 7 days following equipment return and inspection.

24. MINOR CHILD ACTIVITY LIABILITY WAIVER

The Customer confirms they are the parent/legal guardian or have permission for all participating minors.

Activities involve inherent risks. Minors must be supervised at all times. Ready Set Fun Entertainment LLC provides no supervision.

25. ALABAMA DAMAGE CAPS

Customer liability is limited to repair cost or full replacement value unless damage results from theft, misuse, or gross negligence.

26. NERF WARS SAFETY RULES

• No head or face shots

• Minimum shooting distance: 10 feet

• No physical contact

• Adult supervision required

• Recommended minimum age: 6 years old

• No modified darts

Failure to follow rules may end play without refund.

27. FOOD EQUIPMENT SAFETY ADDENDUM

Applies to cotton candy, snow cone, and hot dog equipment.

• Operated by adults only

• No food preparation or service by company

• Customer responsible for sanitation and food safety

• Equipment must be cleaned before return

Ready Set Fun Entertainment LLC is not a food service establishment.
